Article 1 – Definitions

In these general terms and conditions, the following terms shall have the meanings ascribed to them below:

  • Papr Walls: the trade name under which Online Store Academy, a sole proprietorship located at Stroinksbleekweg 48, 7523 ZL, Enschede, registered with the Chamber of Commerce under number 69666784, VAT identification number NL001748502B59, sells children's wallpaper through its webshop. Where these terms refer to Papr Walls, it legally means Online Store Academy, trading under the name Papr Walls.
  • Customer: the natural person who is not acting in the course of a profession or business (consumer) or the legal entity or natural person who is acting in the course of a profession or business (business customer) and enters into an agreement with Papr Walls.
  • Consumer: the customer who is a natural person and is not acting in the course of a profession or business.
  • Products: wallpaper samples, wallpaper rolls, and custom wallpaper offered by Papr Walls.
  • Customization: products manufactured according to the customer's specifications, not prefabricated, and made based on an individual choice or decision of the customer, or clearly intended for a specific person. 
  • Agreement: any agreement between Papr Walls and the customer.
  • Webshop: Papr Walls' online sales environment, accessible via www.paprwalls.com.

Article 3 – Applicability

1. These general terms and conditions apply to every offer made by Papr Walls and to every agreement concluded between Papr Walls and the customer.
2. Before the agreement is concluded, the text of these general terms and conditions will be made available to the customer. The conditions can also be consulted and saved via the webshop.
3. Deviations from these conditions are only valid if agreed upon in writing between the parties.
4. If one or more provisions in these general terms and conditions are void or should be annulled, the remaining provisions will remain fully applicable.

Article 4 – The offer

5. The offer in the webshop contains a complete and accurate description of the products offered. The description is sufficiently detailed to allow for a proper assessment of the offer by the customer.
6. Images on the webshop are a true representation of the products offered. However, colors on a screen may differ from the actual colors of the wallpaper. Papr Walls therefore advises customers to order a wallpaper sample before placing a full wallpaper order.
7. Obvious mistakes or errors in the offer do not bind Papr Walls.
8. Every offer contains such information that it is clear to the customer what rights and obligations are attached to accepting the offer.

Article 5 – The agreement

9. The agreement is concluded at the moment the customer accepts the offer and fulfills the conditions set therein.
10. Papr Walls will promptly confirm receipt of the order by electronic means. As long as receipt of this acceptance has not been confirmed, the customer can dissolve the agreement.
11. Papr Walls takes appropriate technical and organizational measures to secure the electronic transfer of data and ensures a secure web environment.

Article 6 – Prices

12. All prices in the webshop are stated in euros and include VAT, unless otherwise indicated.
13. Shipping costs, any import duties and local taxes are not included in the price and are stated separately during the ordering process. For shipments outside the European Union, additional import duties and taxes may be due; these are at the customer's expense.
14. Papr Walls reserves the right to change prices. Price changes after the conclusion of the agreement do not affect orders already placed, except for changes resulting from legal regulations or provisions.

Article 7 – Payment

15. Payment must be made at the time of ordering via one of the offered payment methods: iDEAL, Bancontact, Klarna, credit card or PayPal.
16. When paying via Klarna (post-payment), Klarna's general terms and conditions apply in addition. By using this payment method, the customer declares to be aware of and agree to these terms.
17. If the customer fails to meet his payment obligation in time, he is legally in default. Papr Walls is then entitled to charge the statutory interest and extrajudicial collection costs in accordance with the statutory regulation.

Article 8 – Delivery and execution

18. Papr Walls will exercise the greatest possible care when receiving and executing product orders.
19. The place of delivery is the address that the customer has made known to Papr Walls.
20. Papr Walls applies the following indicative delivery times, calculated from the moment of payment:

  • Wallpaper samples: 1 to 2 working days within the Netherlands; international delivery times may vary.
  • Wallpaper rolls (standard): 2 to 5 working days within the Netherlands; international delivery times may vary.
  • Custom wallpaper (photo wallpaper): the delivery time will be communicated upon order and depends on the production method.

21. Stated delivery times are indicative. Exceeding a term does not entitle the customer to compensation. In no case will the delivery period exceed 30 days, unless expressly agreed otherwise.
22. In case of non-delivery within 30 days, the customer has the right to dissolve the agreement free of charge. Amounts already paid will then be refunded within 14 days.
23. The risk of damage and/or loss of products rests with Papr Walls until the moment of delivery to the customer or a pre-designated and made known representative to Papr Walls, unless expressly agreed otherwise.

Article 9 – Right of withdrawal

24. The consumer has the right to dissolve the agreement within 14 days without giving reasons. This cooling-off period starts on the day after the consumer, or a third party designated in advance by the consumer, has received the product.
25. During the cooling-off period, the consumer will handle the product and its packaging with care. The consumer may only unpack or use the product to the extent necessary to determine the nature and characteristics of the product.
26. The right of withdrawal expressly does NOT apply to:

  • Custom wallpaper (photo wallpaper) and other custom-made products that have been manufactured according to the consumer's specifications and are not prefabricated.
  • Wallpaper rolls of which the seal or packaging has been opened or removed.

27. For production errors in custom work, the right of withdrawal does not apply, but the consumer can invoke the statutory guarantee as described in Article 11.
28. If the consumer wishes to make use of their right of withdrawal, they must notify Papr Walls within the cooling-off period via the model withdrawal form or in another unambiguous manner, via the e-mail address stated in Article 2.
29. The consumer must return the product within 14 days after notifying withdrawal, or hand it over to (an authorized representative of) Papr Walls.

Article 10 – Costs and consequences of withdrawal

30. The costs of return shipment are for the account of the consumer, unless Papr Walls has indicated otherwise.
31. Papr Walls will reimburse all payments received from the consumer, including any delivery costs for the outward shipment, within 14 days of the day on which the consumer notified withdrawal. Papr Walls may wait with reimbursement until it has received the product or the consumer has demonstrated that he has returned the product, whichever occurs first.
32. Papr Walls will use the same payment method for reimbursement that the consumer used, unless the consumer agrees to another method. The reimbursement is free of charge for the consumer.
33. If the consumer has chosen a more expensive method of delivery than the cheapest standard delivery, Papr Walls does not have to reimburse the additional costs for this more expensive method.
34. If the product is damaged or shows signs of use beyond what is necessary to determine its nature and characteristics, the consumer is liable for the depreciation of the product.

Article 11 – Conformity and warranty

35. Papr Walls guarantees that the products comply with the agreement, the specifications stated in the offer, the reasonable requirements of soundness and/or usability and the legal provisions and/or government regulations existing on the date of the conclusion of the agreement.
36. All products are covered by the statutory warranty. This means that the product is or must do what the consumer can reasonably expect from it.
37. In the event of production errors, even with custom work, the consumer can contact Papr Walls within a reasonable period after discovery. Papr Walls will then replace, repair or refund the purchase amount free of charge.
38. Complaints about visible defects must be reported to Papr Walls in writing within 7 days of receipt of the product, with photos of the defect. After processing the wallpaper, the right to complain expires; the customer must therefore check the rolls for visible defects before processing.
39. The warranty does not apply if damage is the result of incorrect or careless handling, processing without observing the processing instructions, or external influences such as moisture, temperature fluctuations or direct sunlight.

Article 12 – Liability

40. Papr Walls' liability is limited to at most the invoice amount of the relevant order, except in cases of intent or gross negligence.
41. Papr Walls is not liable for indirect damage, including consequential damage, lost profits, missed savings and damage due to business stagnation.
42. Papr Walls is not liable for damage caused by incorrect processing or application of wallpaper, for color deviations between batches of wallpaper ordered separately, or for color differences between the screen and the actual product.
43. The limitations included in this article do not apply if the damage is the result of intent or deliberate recklessness on the part of Papr Walls.

Article 13 – Force majeure

44. Papr Walls is not obliged to fulfill any obligation if it is prevented from doing so due to force majeure. Force majeure also includes: disruptions at suppliers, transport problems, epidemics, pandemics, war situations, government measures and extreme weather conditions.
45. If the force majeure situation lasts longer than 30 days, both parties have the right to dissolve the agreement without judicial intervention, without thereby creating any right to compensation.

Article 14 – Intellectual property

46. All intellectual property rights to the products, designs, images, texts and the webshop itself offered by Papr Walls belong exclusively to Papr Walls or its licensors.
47. The customer is not permitted to reproduce, distribute, commercially exploit or modify the designs, images or other content without the prior written consent of Papr Walls.

Article 15 – Personal data

Papr Walls processes personal data in accordance with its privacy statement, which can be consulted at www.paprwalls.com/privacy. This processing takes place in accordance with the General Data Protection Regulation (GDPR).

Article 16 – Complaints procedure

48. Complaints about the execution of the agreement must be submitted to Papr Walls via info@paprwalls.com within a reasonable period, fully and clearly described.
49. Submitted complaints will be answered within a period of 14 days, calculated from the date of receipt. If a complaint requires a longer processing time, the customer will be informed of this within these 14 days.
50. Consumers within the European Union can also submit their complaint via the European Commission's ODR platform: https://ec.europa.eu/consumers/odr.

Article 17 – Applicable law and disputes

51. All agreements between Papr Walls and the customer are exclusively governed by Dutch law, even if an agreement is fully or partially executed abroad or if the customer resides there.
52. The applicability of the Vienna Sales Convention (CISG) is excluded.
53. Disputes will be submitted to the competent court in the district where Papr Walls is located, unless mandatory law dictates otherwise. The consumer has the right to opt for settlement by the legally competent court within one month after Papr Walls has invoked this clause in writing.

Article 18 – Amendment of the terms and conditions

Papr Walls reserves the right to amend these general terms and conditions. For agreements already concluded, the conditions as they were in force at the time of the conclusion of the agreement will continue to apply, unless the amendment is legally prescribed.
